It was announced that the ministry of Environmental Protection plans to revise the Guidelines for evaluating air quality in passenger vehicles, which have been in force since March 2012, to make them mandatory.Some people worry that even if the mandatory standards are introduced, whether the relevant car companies can implement them according to the standards, and who will solve the problems if there are problems. This series of questions are worth further investigation.
In the eyes of many, China is a big car country, but in terms of car quality, perhaps the domestic auto industry can only be regarded as an infant who has just learned to walk.For a long time, China has been lacking a clear set of in-car air quality standards until the release of the "Guidelines for In-vehicle Air Quality Evaluation of Passenger Vehicles" in March 2012.Although it has eased consumers 'concerns about the air quality of cars to some extent, the standard is only a recommended national standard, not mandatory, and is not enough to fill the gap in China's automobile air quality supervision and related laws and regulations.As a result, after more than a year of implementation, the improvement in air quality inside the car has been very limited.The case of damping material pollution in the car air of three German luxury brands exposed by CCTV is a good example.
Since the Guide is only a recommended national standard, automobile enterprises can implement it or not.What's more, to improve the air quality in the car, it is necessary to carry out technical upgrading, which will inevitably increase the cost.But even if enterprises increase the cost and improve the air quality in the car, they will not get any subsidy policy. The increased cost will reduce the competitiveness and profit of products.Therefore, in this case, enterprises have little incentive to actively improve the air quality in the car.
For consumers, the guidelines are not mandatory national standards and cannot be used as a basis for rights protection claims.As a recommended standard, the Guide simply allows car owners to test the air quality when they buy a car, and if the test is not up to standard, they can not buy the car.But the owner can not claim compensation according to this standard after the purchase.
Therefore, at the request of all parties, the environmental protection department is preparing to revise the "Guidelines for the Evaluation of Air Quality in Passenger Cars", and it is expected that the mandatory standards for air quality in passenger cars will be issued around 2015.
It can be expected that once the Guidelines become mandatory industry standards, they will help improve in-car air quality, but it is not optimistic how much improvement can be achieved.
As far as the current situation of domestic air quality testing is concerned, due to the lack of corresponding policies, regulations and identification standards, most in-car air quality testing can only be based on indoor air quality testing standards, and most of them are for in-car air quality testing after car decoration, rarely for "bare car" testing.In a sense, this kind of test report does not have legal effect, can only be used as a reference for consumers to buy cars.
In China, car companies do not recognize the certificates provided by third-party testing institutions, and national authoritative testing institutions usually do not accept personal testing.This left many victims with no way out and eventually nothing to do.
Therefore, only by taking real action to improve the air pollution in cars can the implementation of the Guide be put on the track of rule of law and help the automobile industry to enter a new vehicle environment.It will prompt automobile manufacturers to upgrade the materials used in passenger cars to meet the legal standards, and also enable consumers to have the right to know about the air pollution in their cars. With more health and environmental awareness, the car environment will also be more guaranteed.
